Deck Member Terms of Service
Curated Technologies Limited (trading as SwipeOnDeck)
Effective date: 15 September 2026
1. About these terms
These Member Terms (“Terms”) govern your use of Deck as someone who joins a community or buys a ticket to an event. They form a binding agreement between you and Curated Technologies Limited, a company registered in England and Wales (company number 16236839), registered office 92 Seager Drive, Cardiff, CF11 7EX, United Kingdom, trading as SwipeOnDeck and Deck (“Deck”, “we”, “us”).
VAT registration number 497088925.
Separate Organiser Terms apply to the people and organisations who run communities and events on Deck. If you run a community as well as attending events, both sets apply to you in those different capacities.
By creating an account, joining a Community, or buying a Ticket, you agree to these Terms. If you do not agree, do not use Deck.
2. Definitions
- Booking fee: the fee we charge on each Ticket, added to the Ticket price at checkout and paid by you.
- Community: a group created and run by an Organiser on Deck.
- Event: an event listed on Deck by an Organiser, whether ticketed or free.
- Member (“you”): a person who joins a Community or buys a Ticket to an Event.
- Organiser: the person or organisation running a Community and its Events.
- Ticket: a right of admission to an Event, issued through Deck.
3. Our role, and who you are dealing with
This section matters more than any other, so we have put it near the top.
3.1 Deck is a platform. Events on Deck are run by Organisers, not by us. We do not run events, choose venues, set prices, or decide who gets in.
3.2 When you buy a Ticket, your contract for that Event is with the Organiser. We act as the Organiser’s agent for the limited purpose of listing the Event, issuing your Ticket, and collecting payment on their behalf. We are not a party to your contract with them.
3.3 We are not the merchant of record for Ticket sales. Payment is taken on the Organiser’s own payment account with Stripe.
3.4 The Organiser is responsible for the Event: whether it goes ahead, what happens there, safety, and delivering what was described. They are also responsible for their own refund policy.
3.5 We are responsible for Deck itself: your account, issuing and validating your Ticket, taking your payment correctly, and the messages we send you about your booking.
3.6 We are responsible directly to you for the Booking fee, because that is our charge rather than the Organiser’s.
4. Your account
4.1 You must be at least 18 to hold a Deck account, because having one means agreeing to these Terms and paying for Tickets. You do not need an account to attend an Event. You can buy Tickets for other people, including children, where the Organiser allows that age group at their Event. If you buy a Ticket for someone under 18, you are responsible for them at the Event and for satisfying yourself that the Event is suitable for them.
4.2 You must give accurate information and keep it up to date, including the email address we send your Tickets to.
4.3 You are responsible for keeping access to your account secure. We do not use passwords: we sign you in with a link or a code sent to your email address or phone number, or through your Google account, so anyone with access to those can access your account and your Tickets. Do not forward sign-in links or codes.
4.4 Tell us promptly if you think someone else has accessed your account.
4.5 We may create an account for you automatically when you buy a Ticket without registering first. You can sign in to it using the link in your confirmation email.
4.6 We may suspend or close your account in the circumstances set out in §13.
5. Joining a Community
5.1 Organisers decide who may join their Community and who may attend their Events. They may set their own rules, provided they act lawfully and do not discriminate unlawfully.
5.2 When you join a Community or buy a Ticket, the Organiser receives your name, email address and booking details so they can run the Event. They become responsible for that information separately from us. See §11 and our Privacy Policy.
5.3 Some Communities are organised around a subject that data protection law treats as sensitive, for example health or recovery, religion or belief, ethnicity, political views, or sexual orientation. Where an Organiser has told us their Community is of that kind, we will ask for your explicit consent before you join or buy. You can withdraw that consent at any time.
5.4 You can leave a Community at any time. Leaving does not cancel a Ticket you have already bought.
6. Buying a Ticket
6.1 Ticket prices are set by the Organiser. We do not set them. The Organiser also sets the refund policy for their Event, and it is published on the Event before you buy. Read it first, because it decides what happens if you later cannot attend. See §8.
6.2 We add a Booking fee to the Ticket price at checkout. It is shown to you before you pay, and it is paid by you on top of the price the Organiser set. Our current rates are 50p per Ticket for Tickets priced under £10, and £1 per Ticket for Tickets priced at £10 or more.
6.3 There is no Booking fee on free Events.
6.4 Payment is taken by Stripe. Your card details go directly to Stripe and we never see your full card number.
6.5 Your Ticket is confirmed when payment succeeds. We will send you an order confirmation and your Ticket as two separate emails.
6.6 Some Events require the Organiser to approve you first. In that case you submit a request, and nothing is charged unless and until the Organiser approves it. If they approve, you will be sent a link to pay, which expires after the period stated in that email. Your place is not held until payment completes.
6.7 Where an Event is sold out you may be able to join a waitlist. If a place opens we will email you an offer with a deadline. Offers are first come, first served, and if you do not claim in time the place passes to the next person.
6.8 If you buy more than one Ticket, all of them are sent to you in a single email, numbered so you can pass the right one to each person coming with you.
7. Your Ticket
7.1 Tickets are digital and carry a code that is scanned when you arrive. You will need it on your phone or printed.
7.2 A Ticket admits one person to one Event. If you bought several, give each attendee their own.
7.3 Tickets are for personal use. You may pass a Ticket to someone attending with you, but you may not resell it, sell it above face value, or offer it through a ticket resale site. We may cancel Tickets we reasonably believe have been resold, without refund.
7.4 Your Ticket code refreshes for security. Do not share screenshots of it more widely than the person attending, because the first valid scan admits the holder and later scans of the same Ticket will be refused.
7.5 The Organiser may refuse entry, for example on safety grounds, for breach of their published rules or the venue’s rules, where an age restriction applies, or where capacity requires it. Whether you get a refund in that situation depends on the Organiser’s refund policy and on your legal rights.
7.6 If you cannot find your Ticket, you can sign in to your account and send it to yourself again.
8. Changes, cancellations and refunds
Two different things govern refunds and it helps to keep them apart. If you change your mind, the Organiser’s own refund policy decides what happens. If the Organiser cancels the Event or changes it materially, your legal rights decide, and no Organiser policy can take those away.
8.1 Refund policies are set by the Organiser, not by Deck. Each Organiser writes their own and must publish it before you buy. We do not set it, we do not control it, and we cannot override it. Policies vary from one community to the next, so read the refund policy on the Event you are buying, because that is the one that applies to you.
8.2 Event Tickets do not come with an automatic 14-day right to cancel. Consumer law excludes contracts for leisure activities taking place on a specific date from the usual distance-selling cancellation right. So your ability to get a refund depends on the Organiser’s published policy and on your statutory rights if something goes wrong, rather than on a general right to change your mind.
8.3 If an Organiser cancels an Event, you are entitled to a refund of what you paid for your Ticket, including the Booking fee.
8.4 If an Organiser materially changes an Event, for example the date, the start time, or the venue, you may ask for a refund if the change means you can no longer attend.
8.5 Where a Ticket price is refunded, your Booking fee is refunded to you as well. You get back everything you paid.
8.6 Refunds are returned to the payment method you used and usually take 3 to 5 business days to appear.
8.7 If you cancel a Ticket yourself, or you simply cannot make it, whether you get any money back is entirely down to the Organiser’s published refund policy. Some Organisers refund up to a cut-off, some do not refund at all, and both are allowed. If their policy says no refund, we cannot give you one.
8.8 If you believe you are legally entitled to a refund and the Organiser has not given you one, contact us at hello@swipeondeck.com.
8.9 Nothing in this section affects your statutory rights.
9. Attending Events
9.1 You must follow the Organiser’s rules and the venue’s rules while you are at an Event.
9.2 You must behave lawfully and considerately towards other attendees, the Organiser, and venue staff.
9.3 An Organiser or venue may remove you from an Event for unlawful, unsafe, or seriously disruptive behaviour. You will not normally be entitled to a refund in that situation.
9.4 Organisers set any age restrictions for their own Events, including whether under-18s may attend and whether they must be accompanied. Meeting the age requirement for a Deck account does not mean you or your guests meet the requirement for a particular Event.
9.5 If something goes wrong at an Event, raise it with the Organiser first, since the Event is theirs. If you cannot resolve it, contact us and we will help where we can.
10. Messages you will get
10.1 We send you service messages about your bookings: order confirmations, Tickets, reminders before an Event, notice of changes or cancellations, and refund confirmations. These are part of your booking rather than marketing, so they are sent whatever your other preferences are and you cannot unsubscribe from them while you hold a Ticket.
10.2 Communities you have joined can send you updates about their Events. Those messages come from the Organiser, in their name, sent through Deck. The Organiser decides what they say.
10.3 You can unsubscribe from a Community’s updates at any time using the link on those messages. Unsubscribing from one Community does not affect any other, and it does not stop the service messages in §10.1.
10.4 Deck does not send you marketing emails of its own.
11. Your data
11.1 How we handle your personal data is set out in our Privacy Policy, which forms part of your agreement with us.
11.2 When you join a Community or buy a Ticket, the Organiser receives your details and decides how to use them for running their Community. They are responsible for that use, and their own privacy information governs it. We require Organisers to handle your data lawfully and not to sell it, but we do not control them.
11.3 Where §5.3 applies, we rely on your explicit consent to hold the information that reveals the sensitive nature of that Community. You can withdraw it at any time, and we will then delete those records other than transaction records we are required by law to keep.
11.4 You have rights over your data, including access, correction, deletion and objection. The Privacy Policy explains how to use them.
12. Our platform
12.1 We will provide Deck with reasonable skill and care.
12.2 Deck is otherwise provided as is. We do not promise that it will always be available, uninterrupted, or free of errors.
12.3 If Deck is unavailable when you arrive at an Event, the Organiser is still responsible for admitting you. We provide Organisers with a downloadable attendee list so they can check people in without the platform.
12.4 We may suspend access for maintenance, security, or urgent fixes, and will give notice where we reasonably can.
13. Suspending or closing your account
13.1 You can close your account at any time. Tickets you have already bought remain valid, and we will keep the records we need to honour them and to meet our legal obligations.
13.2 We may suspend or close your account where you materially breach these Terms, where we reasonably suspect fraud or unlawful activity, where there is a serious safety risk, or where the law requires it. Where a breach can be put right, we will give you notice and a chance to put it right first, unless the circumstances make that inappropriate.
13.3 If we close your account, we will tell you what happens to any Tickets you hold for Events that have not yet taken place.
14. Liability
14.1 Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot lawfully be excluded or limited.
14.2 We are not responsible for Events. That includes whether an Event goes ahead, what happens at it, its safety, the conduct of anyone attending, and anything the Organiser does or fails to do. Those are the Organiser’s responsibility under §3.
14.3 Subject to §14.1, our total liability to you in connection with these Terms, whether in contract, tort (including negligence), breach of statutory duty or otherwise, is limited to the greater of (a) £1,000 and (b) the total amount you paid through Deck in the 12 months before the claim arose.
14.4 We are liable for foreseeable loss caused by our breaking these Terms or failing to use reasonable skill and care. We are not liable for loss that is not foreseeable, or for loss arising from your own breach of these Terms.
14.5 You are a consumer, and nothing in these Terms removes or limits your statutory rights. Where any term conflicts with those rights, your statutory rights prevail.
15. Changes to these Terms
15.1 We may update these Terms. For material changes we will give at least 30 days’ notice by email or in the app, and tell you plainly what has changed.
15.2 If you do not accept a material change you may close your account before it takes effect. Tickets you already hold are governed by the Terms that applied when you bought them.
15.3 Changes required by law or for security may take effect immediately.
16. General
16.1 Severance: if any provision is unenforceable, the rest continues to apply.
16.2 No waiver: if we do not enforce a right straight away, we do not lose it.
16.3 Third parties: no one other than you and us may enforce these Terms.
16.4 Governing law: these Terms are governed by the law of England and Wales. You may bring proceedings in the courts of England and Wales, or in the courts of the country where you live.
16.5 Complaints: if you are unhappy with something we have done, email hello@swipeondeck.com and we will try to resolve it. If we cannot, you may be able to use an alternative dispute resolution scheme, and you can complain to the Information Commissioner’s Office about how we handle your personal data.
